Queer associations are concerned about plans for gender entry
If you have the name and gender entry changed, you want to leave your former official identity behind. But that will be more difficult with a new project by the Interior Ministry, fear associations.
The Federal Ministry of the Interior trigger concerns with queer associations. The Ministry wants people who have their gender entry and first names in the civil status register change three new data sheets for the earlier gender entry. Other authorities such as the pension insurance and the Federal Central Tax Office should then be informed about the innovations.
Association sees massive intervention in privacy
According to the Interior Ministry, the reason for the project is the entry into force of the self -determination law on November 1 of last year. This makes it easier to have gender entry and first names changed in the office. Previously, elaborate reports and a court decision were necessary.
The German Society for Trans*and Inter*gender (DGTI) explains to the project of the Interior Ministry: “We see it in this a massive intervention in privacy and a contradiction to the self-determination law.” In view of the increasing figures of hate crime, it is urgently needed to protect gender and sexual identity in the Basic Law and not to disclose them by additional markings.
The Association Queere Diversity is very expressed: “The recording, transmission and revelation of the sensitive information about previous gender entries and first names and thus always about the transformation of a person may only be done under narrow conditions.” However, a separate data sheet with the earlier gender entry emphasizes these facts.

Both associations also consider additional requirements to be unnecessary. “It is unclear why authorities such as pension insurance must be informed separately about a change in civil status,” writes the DGTI. “Insured persons share changes to the pension insurance themselves because the social security number changes.”
Ministry of the Interior defends plans
The Ministry of the Interior defends the project. The regulation ensures that people who had changed gender entrance and first names could continue to be identified in official registers and information systems and that their identity is understandable. “This is also a prerequisite for updating the data already stored for the person.”
The authorities to which the data go would also be able to identify and enforce the so -called revelation ban with the change. This stipulates that the genital information entered up to the change and the previous name may not be “revealed or researched” without the consent of those affected. A certain exception to law enforcement or security authorities apply.
The Association Queere Diversity finds this strange. “It appears paradoxical that the ban on revelation is to be ensured by expanding and transmitting the information.”
The queer officer of the Berlin Senate, Alfonso Pantisano (SPD), spoke in a guest post for the “Queer” portal of an “attack on our freedom”. “If we humans systematically grasp just because they have freed themselves, we transform self -determination into a risk index. We turn state care from state care. And then it is only a small step from the database to state persecution.”
