According to reserved in the Union against the Potsdam lawyer Brosius-Gersdorf, the election of three constitutional candidates in the Bundestag is postponed. Prime Minister Woidke makes a suggestion.

Brandenburg’s Prime Minister Dietmar Woidke (SPD) suggests a complete exchange of the previous names in the stuck dispute over the occupation of three posts at the Federal Constitutional Court. “I think it is necessary that the parliamentary groups in the Bundestag quickly find a way out of this situation and submit a solution proposal,” said Woidke of the German Press Agency. “In my view, this way out can only be that all candidates are withdrawn and this procedure is completely re -set by the factions in the German Bundestag.”



Woidke thus occupies a different position than the SPD in the federal government, which continues behind her candidate Frauke Brosius-Gersdorf. The procedure does not make good light on the Berlin coalition at the federal level, said Woidke. “It is not understandable to me that a qualified candidate has been discredited in this way by parts of the CDU/CSU. Unfortunately, the CDU/CSU was not possible with the lack of leadership with the CDU/CSU.”

Reservations in the Union


The election of three judges for the Federal Constitutional Court was taken on July 11 by the agenda of the Bundestag because there was resistance within the Union faction against Brosius-Gersdorf. The top of the parliamentary group could no longer guarantee the consent to her – although that was previously promised. As a further candidate, the SPD proposed the constitutional lawyer Ann-Katrin Kaufhold, the Union has nominated the Federal Labritator Günter Spinner. CSU state group leader Alexander Hoffmann had suggested to lace up a new judge package – that met with resistance at the SPD and the Greens.




Against Brosius-Gersdorf there are reservations in the Union, among other things because of their members from the perspective of some MPs to liberal attitude towards abortions and their positive attitude to an obligation to vaccinate during the Corona crisis. Brosius-Gersdorf has held the chair for public law, in particular constitutional law and social law, at the University of Potsdam since 2021.

Woidke: Include the green and left

The Brandenburg Prime Minister appealed to everyone involved. He advised to involve the opposition parties out of early. “The parties that are needed for a two-thirds majority must be included at an early stage-these are the Left Party and the Greens.”
