AfD MP Daniel Halemba will have to go to court from January

The controversial Bavarian AfD politician Daniel Halemba has to go to court. According to the court, the court opened the main proceedings on Thursday and largely allowed the public prosecutor’s office against the 24-year-old MP for sedition, money laundering, property damage, coercion and attempted coercion.

From January 7, 2026, eight trial days were scheduled by the youth lay judge at the Würzburg District Court, the court announced.

The suspicion of sedition against the member of the state parliament is based on playing the song “Watch on the Spree” The music band Landser argues the public prosecutor. The group is classified as a criminal association. The song went on Halemba’s birthday party in July 2022. In the text, the Turkish population lives in Germany. Halemba argues that he was not present at the celebration at the time.

On the other hand, the court sees no sufficient suspicion of the accusation of the use of indicators of unconstitutional and terrorist organizations – in this regard, the prosecution of the Würzburg public prosecutor was not approved. Halemba is said to have displayed an SS command from 1939 in his room in a Würzburg student connection. Because he did not show the SS command publicly, there is no criminal liability, the district court said.

Halemba rejected all allegations. He assumes that there will be an acquittal. He criticized the schedule in January because the time of the local election campaign had started and the state parliament’s plenary sessions took place. The presumption of innocence applies until a final conviction.

A youth judge is responsible for the procedure because Halemba still falls under juvenile justice in part of the accused acts due to his age – he was sometimes only 20 years old and thus adolescents. According to the court, there are still requests for bias against the chairman of the responsible juvenile judge, which has not yet been decided. Halemba himself announced that this had been granted. The court, on the other hand, said that it has not yet been decided.

The public prosecutor has been investigating Halemba for a long time. As early as September 2023, there was a search in the house of the Teutonia Prague fraternity in Würzburg, which belonged to Halemba. The suspicion of using license plates arose. In October 2023, Halemba was arrested on the basis of an arrest warrant, and the arrest warrant was later taken out.

In April 2024, the public prosecutor also started investigations into suspected money laundering, property damage and coercion. Among other things, he is said to have pressed a lawyer and damaged his office door.

Halemba moved to the Bavarian state parliament after the state election in October 2023. He is a member of the parliamentary committee, according to the AfD parliamentary group, he is also their spokesman for topics related to volunteering. Halemba’s state parliament took up immunity for the public prosecutor’s investigation.

In the meantime, the AfD aimed for a party exclusion from the MP, against whom there were also party -internal allegations about the incontested admission of new members. The procedure ended with a kind of comparison in September last year. Halemba was allowed to stay in the AfD, but was occupied with a one and a half year ward lock and had to vacate party posts.
