Against the protection of the constitution: AfD moves to the constitution

The AfD classifies the protection of the constitution as “secured right -wing extremist”. The party has been fighting against it for years and is now trying to do it before the highest court.

In the legal dispute with the Federal Constitutional Protection on the classification as a so -called suspected case, the AfD claims to complain before the Federal Constitutional Court. The party leader Alice Weidel and Tino Chrupalla said that an extensive constitutional complaint had been submitted.

The background is a procedure that has been ongoing for more than three years, which has already been carried out by several instances. This is not the procedure against which the AfD also took place against which in May – and initially set back on ice for the time of judicial clarification – higher levels of the party as “secured right -wing extremist struts” by the protection of the constitution.

AfD defends itself against the protection of the constitution

The AfD has long been under observation at the domestic secret service for suspicion of anti -constitutional efforts (suspected case). She had complained about it. The North Rhine-Westphalian Higher Administrative Court in Münster decided last year in favor of the intelligence service. He can therefore rightly classify the party as an extremist suspicion and can observe it accordingly using intelligence agents.

The OVG had not allowed a revision. In contrast, the AfD had filed a complaint with the Federal Administrative Court in Leipzig. This was rejected by the court a few weeks ago. With the complaint in Karlsruhe, the AfD is now taking the next step.

All funds available in a constitutional state will be exploited to protect themselves and the members “from these baseless state insults of the Office for the Protection of the Constitution,” said Weidel and Chrupalla.
