Judge: National Guard must not do any police work in LA

In June, the US government mobilized national guards and marine fans for an assignment in Los Angeles. Now there is a legal damper for US President Trump.

US President Donald Trump has suffered a legal setback in the use of the National Guard in Los Angeles. A judge ordered that the soldiers currently stationed in the California city of the million do not be allowed to do any police tasks for prosecution. Specifically, it is about arrests, arrests, searches, confiscations, security patrols, traffic controls and security of evidence. The arrangement of the California court is not about the overarching question of whether the National Guard may be in LA at all.

The court’s injunction, which is limited to the state of California, is also relevant because it is currently afraid of the democratically guided city leaders from Chicago that Trump could soon send the military to this city of the million. The President recently described Chicago as the “most dangerous city in the world”.

Richter: There was no rebellion in La

Judge Charles Breyer wrote. “However, there was neither a rebellion nor were the law enforcement authorities unable to react to the protests and enforce the law.” The decision will only be effective on Friday afternoon (local time) next week. So Trump’s team still has time to act against it.

The governor of California, Gavin Newsom, complained. The Democrat, which parodies the president on social media, wrote on X in Trump-Manner: “Donald Trump loses again”.

Sweeping actions and protests trigger for national gardening

Trump had sent the National Guard to LA in June due to protests against abuse agencies from the immigration authority ICE – against Newsoms. In the meantime, the 700 marine fans and a large part of the national guards have been deducted from the city again. According to the court document, the US government stated that 300 of the once 4,000 national guards were recently in Los Angeles.

In the United States, the governors of a state usually have control over the national guard. If there is a war or national emergencies, the US President can take command. The National Guard is a military reserve unit and part of the US armed forces. For example, it can be used for natural disasters, unrest or emergencies inside. In Washington, where Trump also uses national guards, citing allegedly excessive crime, the case is stored differently. In the capital, the soldiers are already subject to the president.

The case at the California court revolves around the interpretation of the Posse Comitatus Act from 1878, which excludes the military from regular civil prosecution. According to the Ministry of Justice, the law was created to avoid abuse. However, there are exceptions.
