Visa for Afghans: Government very often loses to court

More than 2,000 Afghans in various recording programs are waiting in Pakistan to leave Germany. Dozens have turned to Berlin’s courts in urgent procedures.
In the dispute over admission commitments for Germany, the Administrative Court of Berlin decided until the beginning of September in 32 rush in favor of Afghan women. The award of entry visa was usually ordered, as a court spokeswoman said at the request of the German Press Agency. In a few cases in the event of outstanding security checks, the judges would have obliged the government to make at least a decision on the visa applications.
It is about people in the so -called federal recording program, who have a promise for admission in Germany because of special danger. Many have been waiting for entry visa for months.
In total, 64 urgent procedures of people with such commitments had been received by the Administrative Court of Berlin until the beginning of September. In addition to the 32 cases decided in favor of the plaintiffs, ten lawsuits were rejected, the spokeswoman said. The rest are not yet decided.
Many complaints are unsuccessful
In several cases, the Federal Foreign Office lodged a complaint against the decisions – but often without success. As the Higher Administrative Court of Berlin-Brandenburg announced on request, the judges in second instance rejected the complaints of the Federal Foreign Office. In two cases, the Foreign Office withdrew its complaint. In two cases it was successful before the OVG. Not all complaints have yet been decided, and new cases were received, said a spokesman.
In total, the OVG already decided 28 complaint procedures this year “regarding Visa Afghan citizens”, as the speaker continued. Both dishes pointed out that in addition to the federal recording program, there are other programs for Afghans, such as the local worker procedure or the list of bridging. Different legal conditions apply.
2,000 waiting in Pakistan
More than 2,000 Afghans are currently waiting for a departure to Germany as part of the various recording programs in Pakistan. The Pakistani authorities had recently arrested several people despite commitment to admission from Germany. Dozens were deported to Afghanistan.
