Judges are sought for the Federal Constitutional Court. The coalition in Berlin had recently quarreled violently. Now there is a new schedule.
Who will be the new judges at the Federal Constitutional Court? The schedule for the election is now: According to a report by the “Handelsblatt”, the Bundestag should vote on the three new judges on September 25. The prerequisite is that the election committee of the parliament three days earlier, on September 22nd, approves the candidate Sigrid Emmenegger newly nominated by the SPD. This can be seen from a letter from the first parliamentary managing director of the Union faction, Steffen Bilger (CDU), to whose members, which is available to the newspaper. A spokeswoman for the parliamentary group confirmed the data mentioned in the letter.
On Wednesday, the SPD and Union parliamentary leaders announced that Emmenegger is the new candidate of the Social Democrats. She has been a judge at the Federal Administrative Court in Leipzig since 2021. Emmenegger takes the place of Frauke Brosius-Gersdorf, who had withdrawn from the occupation question about the constitutional court after the Union faction denied the support.
The election committee of the Bundestag had spoken out for Brosius-Gersdorf despite existing resistances in the Union in July, as well as for the second SPD candidate, Professor Ann-Katrin Kaufhold, and for the judge Günter Spinner proposed by the Union. But three days later, the votes in the plenum were taken from the agenda of the Bundestag about the three proposals.
Massive coalition noise for election of judges for the Federal Constitutional Court
In the Union faction, massive resistance to Brosius-Gersdorf had built up after, among other things, due to positions on the right to abortion. The government alliance of Chancellor Friedrich Merz (CDU) seemed to have reached the mode of dispute three months after his start, which was known from the traffic lights.
Emmenegger must be nominated by the election committee with a two -thirds majority. A two -thirds majority of the votes cast is also required when voting in parliament. This means that the coalition is dependent on voices from the opposition – especially the Greens and the left. They had once again been upset about a lack of integration into the procedure. Another open question is whether the labor judge set up by the CDU/CSU may only come into office with votes from the AfD.
