After the Bundestag election, a party of the AfD gives trouble with its landlord in Berlin. Now a court has made its decision.
According to a judgment, the AfD must vacate its federal office in Berlin in autumn 2026 – and thus a year earlier than the rental agreement provided. With a party after the Bundestag election 23 in the courtyard of the office building, the party had violated contractual obligations, the district court of Berlin decided. However, judge Burkhard Niebisch explained this without notice without notice.
This means that the AfD has successfully resisted a corresponding eviction action. “A big day for my party. You see me very happy,” said the deputy AfD Federal Spokesman and member of the Bundestag Kay Gottschalk, who represented his party at the hearing.
Evacuation of September 30, 2026
According to the judgment, the party must vacate the majority of its rooms on September 30, 2026. It must have left the rest of the area at the latest on December 31, 2026.
Appeal to the Berlin Chamber Court, the next higher instance, can be filed against the judgment. The plaintiff initially left open whether he accepted the judgment. “For the judgment itself, no matter how this fails, we can only comment after submitting and analyzing the reasoning,” said Austrian investor Lukas Hufnagl on Thursday.
The ownership company of the little centrally located property in the Reinickendorf district had terminated the party without notice – without giving it beforehand. The rental contracts actually run until the end of 2027, but special rights of termination are provided.
