With the party after the Bundestag election on February 23 in the courtyard of the office building, the party committed violations of the contract, said judge Burkhard Niebisch. However, this does not justify this without notice, since there was no warning before.

“A big day for my party. You see me very happy,” said the deputy AfD Federal Spokesman and member of the Bundestag Kay Gottschalk, who represented his party at the hearing.


Evacuation of September 30, 2026

According to the judgment, the party must vacate the majority of its rooms on September 30, 2026. It must have left the rest of the area at the latest on December 31, 2026. These deadlines are based on special termination rights that the AfD also recognized. The rental agreement itself went until the end of 2027.




Appeal to the Berlin Chamber Court, the next higher instance, can be filed against the judgment. For this, the participants have a month as soon as they have in writing.


Judgment not legally binding

The plaintiff initially left open whether he accepted the judgment. “For the judgment itself, no matter how this is, we can only comment after submitting and analyzing the reasoning,” said Austrian investor Lukas Hufnagl on Thursday. According to the judgment, he must pay the costs for the procedure. The background is that he could not enforce an immediate evacuation.





However, the plaintiff had already seen on the verge of the negotiation that he was primarily concerned with the evacuation title. He can immediately commission the bailiff if the AfD does not leave the first rooms on September 30, 2026.

AfD wants to get out earlier





According to its process representative, the party would like to leave its federal office at the end of June 2026 – before the state election in Saxony -Anhalt. “My goal is to make a lot of steam in the planning group that I belong to,” said Gottschalk. According to it, the AfD is looking for a new party headquarters. A purchase is also possible, says Gottschalk.

The party is looking for a more representative fit, which, if possible, should be on a radius of three to three and a half kilometers to the Bundestag. He was “very optimistic” that this succeeds, Gottschalk said. The right -wing extremist AfD is not welcome for many landlords. The search for event rooms is often difficult. Allegations and criminal complaint from plaintiffs





In his declaration before the judgment, landlord Hufnagl announced: “Finally, a pale aftertaste remains with the landlord, who had been open to the AfD and rented out the party in 2022 when nobody was ready in Berlin.”

The investor reported on the court of blackmail attempts and threats from AfD Federal Treasury Carsten Hütter and Federal Managing Director Hans-Holger Malcomeß. According to Hufnagl, Hufnagl filed a criminal complaint with the Berlin public prosecutor’s office at the beginning of July for attempted extortion and coercion.

A spokesman for the authority confirmed the entrance. At the request of the German Press Agency (dpa), he said that it is still being examined whether there was an initial suspicion. The AfD rejects the allegations. “The allegations are fictitious,” said Federal Managing Director Malcome of the dpa. The criminal complaint was “motivated by the process” and only occurred at a late time. Hütter added: “The allegations arise from his imagination.”
