The State Office for the Protection of the Constitution had been classified around three years ago that the AfD was a right -wing suspicion. In November 2023, the Wiesbaden administrative court ruled that the Hessian AfD could be observed. For this reason, the AfD was pulled in front of the Administrative Court. It was also controversial to what extent this classification could be made public as a suspicion.

The State Office for the Protection of the Constitution had argued that there was suspicion of an endeavor directed against the free-democratic basic order at the AfD state association. The administrative court stated in its decision that there were actual indications of this.


In consideration of freedom of expression, the administrative court as a lower court, for example, correctly assumed, among other things, that the AfD is on the case for a so -called ethnic concept. There are also sufficient statements that “directed the human dignity of foreigners, especially asylum seekers, as ethnically” strangers “.

The decision of the Administrative Court is no longer contestable. However, a constitutional complaint is possible. The Hessian Interior Minister Roman Poseck (CDU) had criticized the long procedure for the AfD classification about three weeks ago.




AfD wants to continue to proceed against classification

The AfD itself pointed out that it was only a decision in the urgent procedure. “After the decision in the urgent procedure, the main proceedings are now in front of the Wiesbaden Administrative Court,” said the party. One wanted to stick to this further. “We do not consider the reason of the court to be convincing to classify the AfD as a suspected case and will continue to take legal action.” The main proceedings could take a long time, said an AfD spokesman.
