In the USA, there will probably no longer be a corona mask requirement on trains and planes in the future. A judge came to the conclusion that the health authority had exceeded its powers with these corona rules.
A federal judge in the United States has declared the nationwide mask requirement on public transport unlawful and has lifted it. Judge Kathryn Kimball Mizelle of Tampa, Florida said on Monday that the CDC had exceeded its powers by requiring a mask. It was initially unclear whether the US Department of Justice would appeal the judge’s decision.
Mizelle also argued that the CDC did not adequately justify its regulation of the mask requirement. The mask requirement applied, among other things, to planes, trains, subways and buses. It was introduced by the CDC in early February 2021 and only recently extended until at least May 3 in view of the rising number of corona infections.
Jen Psaki calls decision ‘disappointing’
White House spokeswoman Jen Psaki called the judge’s decision “disappointing”. She pointed out that the CDC still “recommends” wearing masks on public transport. The Justice Department initially did not comment. It would have jurisdiction over a possible challenge to the judicial decision.
The traffic safety authority TSA announced that it considers the previous directives on wearing masks in public transport to be irrelevant for the time being and will no longer implement them. For their part, several US airlines announced that wearing a mask is no longer mandatory, at least on their domestic flights. A spokesman for United Airlines said that this applies “immediately” to passengers and staff.
Corona mask requirement in the USA under pressure
The government of US President Joe Biden had recently been increasingly confronted with demands to relax or abolish the obligation to wear masks on public transport. Parliamentarians from the opposition Republicans, around 20 Republican-governed states and a number of airlines had called for this.
