Pandemic: Federal court reviews compulsory corona vaccination in the Bundeswehr

A corona vaccination has been mandatory for soldiers for months. Two officers refuse. Her complaints have now been heard at the Federal Administrative Court.

On Monday, the Federal Administrative Court dealt with the compulsory corona vaccination in the Bundeswehr. Two Air Force officers are opposed to the inclusion of the corona vaccination in a list of vaccinations that are mandatory for soldiers.

Above all, they see their basic right to physical integrity violated. It is not yet foreseeable when a judgment will be passed (BVerwG 1 WB 2.22, BVerwG 1 WB 5.22). The soldiers’ complaints were dealt with in detail before the 1st Military Service Senate of the Federal Administrative Court. The court has jurisdiction in the first and last instance. The presiding judge emphasized that a decision only applies to the two officers due to the special nature of the law on military complaints. In total, the court had received about ten complaints from soldiers from different areas.

Soldiers have to be vaccinated against a whole range of diseases if there are no particular health reasons not to do so. These include hepatitis, measles, rubella, mumps and influenza. On November 24, 2021, the Ministry of Defense made a Covid-19 vaccination mandatory in the general regulations for the central service regulation “Vaccination and other prophylactic measures”. Disciplinary action will be taken against anyone who disobeys the vaccination schedule.

The lawyers for the two officers questioned whether the corona vaccination was suitable for preventing communicable diseases. They also doubted that Covid-19 was even a dangerous disease – especially for the professional group of soldiers. For the negotiations in Leipzig, they named the retired professors Sucharit Bhakdi and Arne Burkhardt as experts, among others.

Bundeswehr physicians, on the other hand, emphasized that serious corona cases had also occurred among soldiers and that Long Covid was also a significant health problem. Vaccination side effects, on the other hand, were only very rarely registered. Vaccination is crucial to ensure the operational capability of the armed forces. “Vaccination reduces the risk of transmission – not to zero, but measurable,” said Prof. Roman Wölfel from the Bundeswehr Institute of Microbiology.

According to a preliminary survey by the Ministry of Defense, the proportion of vaccinated and recovered soldiers who are currently fully immunized is 94 percent. The vaccination rate for soldiers on foreign missions is therefore 100 percent. So far there have been around 60,000 corona cases among the 183,638 soldiers.
