Gerhard Schröder is apparently not prepared to accept the deletion of his former chancellor’s office without objection. According to media reports, his lawyer has contacted the responsible budget committee. But Schröder probably doesn’t want to take the conflict to the extreme either.
According to reports, former chancellor Gerhard Schröder (SPD) is opposing the Bundestag’s decision to cut his office and staff positions. The decision by the Budget Committee in May was “evidently illegal and unconstitutional,” according to the letter from Schröder’s lawyer. The lawyer now wants to try to clarify the matter in a conversation.
According to the “Bild” newspaper, the lawyers in the two-page letter referred to a decision by the Bundestag on November 8, 2012, according to which Schröder’s Bundestag offices and four employees were “fixed for life”. In terms of employee positions, Schröder claims four positions with salary levels B6, B3, E14 and E8.
The fact that his office is now “suspended” by a decision of the Budget Committee in May and the staff positions are “handled” is illegal, “Bild” quoted from the letter. However, the SPD politician does not necessarily want to sue for his rights in court.
Schröder lawyer asks for “appealable” decision
According to the “Süddeutsche Zeitung”, the lawyer also writes that Schröder found out about the budget committee’s decision “through the media”. The basis for this decision is the committee’s finding that Schröder no longer “performs ongoing obligations from the office”. However, the “Gazettes” do not reveal what the budget committee means by “ongoing obligations from the office”.
The lawyer is therefore asking committee head Helge Braun (CDU) to send the former chancellor “a verifiable and therefore appealable decision”. At the same time, Schröder’s lawyer Braun is asking for an interview in order “to be able to reach an agreement that is acceptable to all sides and that is ‘on an equal footing'”. According to The Pioneer, Schröder’s lawyer Michael Nagel wrote in a letter that “despite the now unacceptable public hounding” that judicial clarification is not the priority.
Bundestag Vice President Wolfgang Kubicki (FDP) considered Schröder’s protest to be unfounded. “It is perfectly legitimate for Gerhard Schröder to examine all legal means if he believes his rights have been violated,” he told the newspapers of the Funke media group. “In my view, the legal basis that the budget committee relies on when deciding to deny the former chancellor the office is sufficient.”
Gerhard Schröder has been under criticism for months
Schröder has been criticized for months for continuing to work for Russian energy companies despite the war in Ukraine. In the SPD, party order proceedings are under way against the former chancellor, which can lead to his expulsion from the party.
