Federal Constitutional Court: Soon decision on AfD application for committee chairmen

Once again, the AfD is moving to Karlsruhe to have the behavior of the other parties in the Bundestag checked. This time it is about the committees in Parliament.

On Thursday (June 23), the Federal Constitutional Court issued a statement on the rejection of three AfD candidates as committee chairmen in the Bundestag.

Initially, it is all about the urgent application from the AfD parliamentary group, as announced on the court’s website on Monday evening. The decision in the main proceedings is expected at a later date.

AfD candidates without a majority

After the federal elections in September, the interior committee had rejected the police chief inspector Martin Hess as chairman. The candidates Jörg Schneider and Dietmar Friedhoff, nominated by the AfD, failed in the Health Committee and the Committee for Development Cooperation. Previously, contrary to the usual procedure, it had been decided to decide on the presidency in a secret ballot.

Normally, posts are allocated in such a way that the largest faction can choose a committee first, then the second largest – and so on. This means that the chairmen are actually set without a vote. After the description of the AfD candidates in the constitutive meetings of the committees in December, MPs from other parliamentary groups then requested a vote on the chair.

The AfD’s parliamentary manager and parliamentary group legal advisor, Stephan Brandner, said on Monday evening that “decades of practice and applicable law would be broken”. The first parliamentary manager of the group, Bernd Baumann, said on Tuesday in Berlin: “We expect that we will win.” You gave a good reason for that. There is no reason to deny the group these posts.

With the urgent application, the AfD wants to ensure that its candidates are temporarily appointed as committee chairmen until their complaint in Karlsruhe has been finally examined. The decision will be published in writing on Thursday at 9.30 a.m. (Az. 2 BvE 10/21)
