1G is being considered for areas with a particularly high risk of infection, such as night-time catering, but there is also a clandestine discussion about allowing catering in general only to people who have been vaccinated. Gastro chairman Mario Pulker is vehemently against it and would even go to the constitutional judge if a 1G rule in the daytime catering were to come.
“Introducing a 1G rule in normal gastronomy would be tantamount to a lockdown,” said Pulker on Monday. Even now with the 3G rule, the companies would experience a decline in sales of between 15 to 45 percent, according to the gastro-industry chairman. An even stricter rule would be fatal for companies. “You can’t put individual industries at a disadvantage,” says Pulker.
Federal Chancellor Sebastian Kurz (ÖVP) and Health Minister Wolfgang Mückstein (Greens) changed course at the weekend and are considering the introduction of the 1G rule in autumn for areas with a particularly high risk of infection. So far, people wanted to stick to 3G, i.e. the equal treatment of tested and recovered people with vaccinated people. Access to discos and nightclubs, but also to festivals and sporting events, could now only be granted to vaccinated people. According to the catering spokesman for the Freedom Economy, Michael Fürtbauer, the 1G rule is not only being prepared for night-time catering, but also for all catering, hotel and leisure businesses.

Companies have also been asked by parts of the politicians to allow only vaccinated people to enter their facilities. With whom an entrepreneur concludes contracts is largely up to them. “Outside of the world of work, the Equal Treatment Act only prohibits discrimination on the basis of gender or ethnic affiliation, distinctions according to vaccination status are not included,” admitted the lawyer Michael Komuczky von Lansky, Ganzger + Partner in a guest article in the “Presse”.
The proposed 1G rule would be the “absolute death knell” for night gastronomy, said night gastronomy spokesman Stefan Ratzenberger to the APA. His forecast: 90 percent of discos and nightclubs outside of Vienna would be closed. The corona crisis hit them the most: “We were the first to lock up and the last to open,” said Ratzenberger, who sharply criticized Health Minister Mückstein. Mückstein lost control of the vaccination. Also, the PCR offer has still not been rolled out across Austria.
