Director of the Chamber of Fafe to stand trial for abuse of power and forgery

The Court of Appeal of Guimarães (TRG) has decided to prosecute the director of the administrative department of the municipality of Fafe, Braga district, for abuse of power and falsification or forgery of a document, as announced on Monday.

In a note published on the website, the Regional Prosecutor General’s Office of Porto (PGRP) explains that the decision of the TRG was taken after the appeal of the Prosecutor’s Office (MP) against the decision of the Criminal Investigation Court of Guimarães, which was taken on September 30, 2021, did not condemn (did not to court) of the defendant, initially accused by the deputy of embezzlement and forgery of documents or forgery of documents.

The MP’s indictment alleges that the defendant, the director of the administrative department of the city council of Fafi, paid on 30 December 1987 about 8,500 euros (in the current currency) for a plot of land belonging to that municipality.

“However, it has since been unable to enter into a public sale and purchase agreement with the municipality because the land lacks the water and sewer infrastructure that the city council has pledged to complete,” the PGRP said.

The MP is also charged that the defendant, “wishing to take possession of the land, decided to use the functional qualities of a representative of the municipality, which were delegated to him by order of the mayor of Fafe, and a private notary of the municipality.”

Thus, according to the indictment, he prepared “a document which he called a certificate testifying that the city council of Fafe decided to sell the aforementioned plot to one of his sons, a decision that never happened.”

“Armed with this document, acting on its own without any support from the municipality, on March 20, 2013, acting on behalf of the municipality of Fafe, issued in a public contract of sale, in which the aforementioned municipality, as the first grantor and through the mouth of the defendant, declared, that he is selling the lot to his son, who, having entered the business as a second donor, accepted the sale,” explains PGRP.
