Public service: budding federal police officer takes his job with “Like”

A “like” under a homophobic caricature is enough to obstruct a civil servant career. One court sees this as clear evidence of a lack of tolerance and neutrality.

With a «like» under a homophobic caricature, a budding federal police officer has robbed himself of his civil servant career.

“Posts” and “Likes” in social networks can raise doubts about the character suitability for the job of federal police officer, decided the Administrative Court of Aachen after notification on Friday (Az .: 1 L 480/21).

The man had already received a confirmation of employment for the federal police when his activities on the Internet were noticed. For example, the applicant “Like” a caricature showing a man wiping his buttocks with a rainbow flag.

The applicant himself published the notification of a driving ban imposed on him on the Internet and provided it with a “middle finger emoji”. As a result, the employment commitment was revoked.

The man defended himself against this in court. In vain: Even the “like” under the cartoon with the rainbow flag was enough to arouse doubts about his character suitability, the court found. The police profession is particularly characterized by contact with people of different ethnic origins, religions, ideologies and sexual orientations.

With his “Like”, the applicant has proven that he lacks the tolerance and neutrality necessary to carry out his official duties without regard to the person. The federal police are no longer bound by the employment commitment. A complaint against the decision can still be lodged with the Higher Administrative Court in Münster.
