The corona vaccinations are considered effective – but there are side effects. A number of those affected are now demanding compensation. In Bamberg and Rottweil there was a showdown in the courtroom on Monday.
Two courts heard on Monday about claims for damages against manufacturers of corona vaccines. Judgments in the civil trials are not expected for a few weeks. The Higher Regional Court (OLG) Bamberg heard the case of a 32-year-old who had sued the vaccine manufacturer Astrazeneca and had failed in the first instance. The trial of a 58-year-old’s claim for damages against Biontech began in the district court of Rottweil.
The man received his first dose of vaccine in May 2021 and the second in June. Just one day later he had trouble finding words and had problems concentrating, he described in court. He was later diagnosed with an eye attack. As a result, his eyesight is now only three percent. He demands 150,000 euros in damages.
The presiding judge said it would be difficult for the plaintiff to succeed. Among other things, he pointed out that the vaccine had received official approval. The plaintiffs argued, among other things, that there was only provisional approval at the time.
Accusation unfounded?
According to the judge, the Mainz-based company has so far rejected an amicable agreement. Biontech considers the man’s accusation to be unfounded, as a spokeswoman said before the trial. The court could announce a decision at the end of September.
The 32-year-old from Bavaria had been vaccinated with the Covid 19 vaccine from the British-Swedish company Astrazeneca in March 2021 and then suffered what is known as intestinal vein thrombosis. She went into a coma and eventually had part of her intestines removed.
The court explained that the day after the plaintiff’s vaccination, the first reports of thrombosis after vaccination with the substance from Astrazeneca became known. On March 19, 2021, vaccinations with the vaccine were therefore temporarily suspended. Later, the Standing Vaccination Commission (Stiko) recommended it in Germany only for people over 60 years of age. From the lawyer’s point of view, the vaccine should not have been approved at the time his client was vaccinated.
Possible comparison already ruled out
The woman demands from Astrazeneca at least 250,000 euros in damages and up to 600,000 euros for future impairments. The company’s lawyers ruled out a settlement with the plaintiff on Monday. The Hof district court had previously dismissed the woman’s claim. A judgment of the Higher Regional Court is now to be announced on August 14th.
According to a report by “Welt am Sonntag”, which refers to the Federal Ministry of Health, more than 200 claims for damages against producers of corona vaccines are currently pending in courts in Germany. A final decision has not yet been announced. When the corona vaccine was procured via the EU, it was agreed with the manufacturers that in the event of successful lawsuits – except in special cases – the respective member states would pay the manufacturer’s compensation and legal costs.
