New complaint from the EU for Hungary: “Incompatible”

Hungary’s government wanted to prevent judges from calling the European Court of Justice for clarification if there were doubts about the EU conformity of laws or procedures. The legal representatives had even been threatened with disciplinary proceedings.

But now the European Court of Justice (ECJ) has spoken a word of power and once again criticized the rule of law in Hungary. With the judgment announced on Tuesday, the Luxembourg judges defended the right of national courts to refer questions to the top EU judges. Hungary’s new plans are incompatible with the independence of the courts, according to the ECJ.

The EU court had already criticized the rule of law in Hungary several times. Just last week it rejected regulations that make it difficult for non-governmental organizations to help asylum seekers or forbid them to be in breach of fundamental rights. Hungary now has to adjust to severe financial losses. The EU can not only cut the country’s funding of five billion euros. The disbursement of the seven billion euros from the Corona recovery fund is also in danger.
