Politically sensitive
At the end of 2022, classified information from Biden’s time as Vice President was discovered in various locations, including in private offices in the capital Washington and in Biden’s house in Wilmington, Delaware. US Attorney General Merrick Garland then appointed Robert Hur as special investigator for the politically sensitive investigation. Presidents and vice presidents are required to hand over secret documents to the National Archives after they leave office.

Unlike Biden’s case, Trump’s case was preceded by a dispute with the National Archives. It tried unsuccessfully for months to get papers from Trump during his time in office.
