Traffic light coalition wants to abolish controversial advertising ban for abortion

A constitutional complaint is already pending against the advertising ban for abortion – but it could possibly become superfluous. Because the new government in Berlin is planning to delete the controversial regulation.

The new government coalition of Social Democrats, Greens and FDP plans to completely abolish the controversial advertising ban on abortion. The corresponding Paragraph 219a in the Criminal Code will be deleted, according to the new coalition agreement. Doctors have already been allowed to inform about the fact that they offer abortions, but can be punished if they also state the method used.

A complaint is currently pending before the Federal Constitutional Court against the advertising ban. A doctor from the Hessian town of Giessen, because she had informed about abortions on her homepage. With this she wants to challenge a judgment of the Frankfurt Higher Regional Court, “in other countries like Ireland, Argentina, South Korea the laws are being liberalized, nowhere else there is a criminal law paragraph that forbids factual information”.

219a deletion overdue

Social associations and doctors have been calling for reform for a long time because the law is not up to date. “The deletion should have happened years ago, the reform in 2019 brought no improvement,” said Sina Tonk from the women’s rights organization “Terre de Femmes” recently to the editorial network Germany.
