The judiciary is mainly offended by the fact that the lawyer has taken leave of absence and thus has a right of return if she has had enough of the lawyer.
“In general, we can state that parental leave is approved by the official authority. In the case of public prosecutors, these are the senior public prosecutor’s offices,” said the Ministry of Justice on Wednesday, at the request of the APA, explaining the reasons for the parental leave and under what circumstances was approved. In the case of parental leave, the person concerned is “of course still subject to official secrecy after their change. This means that they are not allowed to use or pass on their knowledge on individual cases that they have acquired as a result of their work for the judiciary.”
Department media spokeswoman Christina Ratz told the APA that public prosecutors should always adhere to the internal judicial compliance rules. “We check whether the compliance rules are sufficient and whether amendments are necessary,” Ratz stated on the occasion.
The change of the senior public prosecutor from the WKStA to the office of Manfred and Klaus Ainedter is discussed in the criminal justice system mainly because this was in the VP advertisement affair – in which the WKStA among others against ex-Federal Chancellor Sebastian Kurz (VP) and several short confidants identified on suspicion of breach of trust and bribery – representing the former media officer in the Chancellery, Gerald Fleischmann. According to media reports, Kurz himself, who repeatedly attacked the WKStA sharply, was seen leaving the office on Taborstrasse.
Only the previous week there had been excitement about the Ainedters after it became known that Gabriele Aicher, the legal protection officer of the judiciary and thus the supreme control body over the public prosecutor’s offices, had been advised by senior boss Manfred Ainedter in advance of her harsh criticism of the WKStA. Aicher had seen the house search carried out in the course of the advertisement affair in the media group “Austria” as “crossing a red line”. The VP used Aicher’s statement to launch further verbal attacks against the WKStA.
