EU funds: dampeners for Poland and Hungary

In the rule of law dispute with the EU, there are signs of a severe legal defeat for Poland and Hungary: The Advocate General at the European Court of Justice (ECJ) recommended yesterday in Luxembourg that the complaint of both countries against the rule of law mechanism, which cuts EU funds for both of them, should be dismissed States allows.

In his final motion to the European Court of Justice, Advocate General Manuel Campos Sanchez-Bordona stated that the regulation was compatible with the EU Treaty and “in accordance with the principle of legal certainty”. The final motions are not binding on the judges, but are followed in most cases.

Poland and Hungary had appealed against the regulation that came into force this year, according to which the EU can reduce its member states’ funds from the joint budget. The prerequisite for a reduction is that there is a risk of misuse of the funds due to a violation of the rule of law.

Hungary speaks of “mistake”

The two countries reacted indignantly: Poland’s Deputy Justice Minister Sebastian Kaleta spoke of a “crime against the rule of law”. The Hungarian Minister of Justice Judit Varga spoke of a “mistake”.
