3G and 2G: Night restaurateurs are considering lawsuit for unequal treatment

The Ministry of Health made this clarification on Wednesday – and thus caused anger in the night catering industry. The now “legal steps” are considering, as the spokesman for the Association of Austrian Night Restaurateurs, Stefan Ratzenberger, announced in the ON news conversation. It is “absolutely incomprehensible” that the same rules do not apply here, says Ratzenberger. It is true that they “fully understand” that one should not risk a fourth wave, but such unequal treatment is incomprehensible.

Ratzenberger announced that next Saturday he would like to decide on a legal procedure – an individual application to the Constitutional Court or an appeal to a higher regional court, as he explains, would be possible. The night catering industry also wants to make the decision dependent on a major event in Upper Austria: The Hollerbergfest in Auberg begins on Friday under 3 G-rules. “We’ll be watching it closely when thousands of people come together,” says Ratzenberger, who also wants to watch other tent festivals.
