There’s plenty of champagne at stake at Oktoberfest: AfD politician Maximilian Krah sued TV presenter Jan Böhmermann – and lost.
AfD politician Maximilian Krah suffered defeat in a bizarre champagne dispute with TV presenter Jan Böhmermann. The Düsseldorf regional court rejected Krah’s injunction against Böhmermann, a court spokeswoman said.
Krah wanted to prevent the moderator from claiming that the politician had ordered 200 bottles of champagne for the entire festival tent at the Munich Oktoberfest.
Dem star Krah said he didn’t have the decision yet: “The status of the oral hearing was that Böhmermann’s initial claim was wrong, but he effectively corrected it himself. We still see it differently.” Krah then wants to decide on the appeal based on the reasons for the judgment: “Böhmermann spread fake news about me, that’s clear, and I still don’t intend to let it stand.”
Jan Böhmermann quickly corrected himself
According to the ruling, Krah is not entitled to an injunction because Böhmermann did not make any claims of his own in his podcast “Fest & Fluschig”. Rather, he simply reproduced the letter from a listener verbatim and made this sufficiently clear.
In addition, Böhmermann updated the podcast shortly after publication, so that the original claim can no longer be found there. In the podcast, Böhmermann reduced the initially mentioned number of 200 champagne bottles ordered to 50 and corrected that the bottles were not ordered by the AfD man Krah personally, but from his table.
The court’s decision can be appealed. A statement from Krah or his lawyer was initially not available at the request of the DPA news agency.
