Until the end, the Union, SPD, FDP and Greens had struggled together, now the way for the Bundestag is free: if the law comes through, the right to maternity protection is significantly expanded.

Women who suffer a miscarriage from the 13th week of pregnancy should be entitled to maternity protection in the future. This provides for a draft law on which the factions of the CDU/CSU, the Greens and SPD have agreed according to a joint press release.

It says: “During this meeting week, maternity leave is passed in the German Bundestag in the case of miscarriage. Have decided to say goodbye to the CDU/CSU’s bill. ”

According to the agenda of the Bundestag, the draft will be decided on Thursday evening. According to DPA information, the FDP parliamentary group also wants to agree to the new law.

Regulation applies from 13th week of pregnancy

The draft law provides for a staggered claim for maternity protection, which is to take effect from a miscarriage in the 13th week of pregnancy. In most cases, the maternity leave period is the six weeks before the childhood and the weeks after birth, in which women usually do not work for eight weeks.

In the case of miscarriages – from a medical point of view, the early end of a pregnancy up to the 24th week of pregnancy is not used as a miscarriage. That should change with the new law.

Union sees “women’s political milestone”

The family policy spokeswoman for the Union faction, Silvia Breher, spoke of an “important women’s policy milestone”. A woman who has born her child silently no longer has to try to get a sick leave in the future. You get “a shelter in order to be able to process this difficult loss,” said Breher.

The green family politician Franziska Krumwiede-Steiner pointed out that in Germany every third woman was affected by a miscarriage. A world breaks for these women. It was therefore correct that a gap in the Maternity Protection Act is now being closed.

Number of those affected unclear

How many women would affect the new regulation is unclear. According to the Family Ministry, there are no number of women who have used maternity protection in recent years, nor are there official statistics on the number of women who have miscarriage.

Citing the Fraunhofer Institute for Applied Information Technology (Fit), the Ministry estimates that around 90,000 miscarriages take place annually. Around 6,000 miscarriages occurred between the 13th and 24th week of pregnancy. Most of the miscarriages, 84,000, suffer women up to the 12th week of pregnancy. In these cases, the new draft law does not provide for maternity protection.
