The fact that the AfD could help a majority to a lawy of the Union found the SPD, Greens and Leftists scandalous. But what does the result of the vote mean – beyond political furor?

After hours of discussions in the corridors of the Bundestag and a heated debate, the Union’s draft law was rejected for a limitation of migration in the Bundestag.

What did the Bundestag decide?

The most controversial point of the Union Group’s bill, to which MPs from FDP, AfD and BSW had also signaled approval, is the suspension of family reunification to refugees with limited protection status. This group currently has many Syrians in Germany.

In addition, according to the Union’s ideas, the powers of the federal police should be expanded. In the future, if it meets in its area of ​​responsibility – for example at train stations – who is subject to departure, it should cause deportation to cause deportation, the CDU/CSU suggested.

In its now failed draft, the Union also demanded that the goal of a “limitation” of the influx of foreigners back into the Residence Act. The traffic light coalition, which had now been reduced to red-green at the end of 2022, had deleted this.

No. The interior committee had already advised on the draft in autumn, shortly before the traffic light coalition breaks apart. The idea of ​​not allowing family reunification for people with limited protection status were also not new.

From March 2016 to July 2018, the family reunification for subsidiary beneficiaries was suspended by the then black and red coalition. At the time, this was justified with the intention of avoiding an overload in recording and integration. Since August 2018, a total of 1,000 people have been allowed to enter this protection status as relatives of people. The coalition agreement of SPD, Greens and FDP actually stipulated that family reunification should also be possible to people from this group unlimited again. However, this project was not implemented.

The Union’s now rejected bill literally says: “In view of the admission of more than 1.8 million asylum seekers and Ukraine refugees since the beginning of 2022, the integration capacities in Germany have been exhausted to the foreseeable future that family reunification to people with subsidiary protection has to be ended until further notice. ”

The idea of ​​giving the federal police new powers for deportations was also not new. The Bundestag approved a corresponding draft law of the Black and red federal government in 2021. At that time, however, he found no majority in the Federal Council.

What votes have already existed before?

On Wednesday, an application from the Union had been decided to extend rejections at German borders in the Bundestag because the AfD as well as numerous MPs from the FDP and some framework without a fraction. Politicians from the SPD, the Greens and the left criticized Union faction leader Friedrich Merz (CDU) sharply. They spoke of a “shame” and a “fall”.

Unlike the 5-point plan accepted on Wednesday, the bill on Friday would have had legal consequences. The Federal Government should have implemented the proposed changes – if it had been accepted and the Federal Council had also agreed. In the Federal Council, however, the law would have come across resistance, several Union Minister of the Minister had already announced that they did not want to agree.

What’s next?

The project is buried first. Of course, the Union is free to raise the proposals again after the Bundestag election on the agenda and – in the event of a government participation.
