When it comes to the Dresden Higher Regional Court, Lina E. is supposed to go to prison for attacks on right -wing extremists. The Supreme German Criminal Court examined the judgment.
When the alleged left -wing extremist Lina E. was sentenced to several years in Dresden around two years ago in Dresden, the violent protests triggered in the radical left -wing scene. The Higher Regional Court (OLG) guilty the accused at the time because of several attacks on right -wing extremists and membership in a criminal association. Both E. and the Federal Prosecutor’s Office made a revision against the judgment. Therefore, the Federal Court of Justice (BGH) in Karlsruhe is now devoted to the case.
The 29-year-old E. is not expected today at the hearing at the BGH. The arrest warrant against you was understood with the Dresden judgment in 2023 under conditions – after two and a half years in custody, it was initially released despite the imposed imprisonment of five years and three months.
The remaining penalty only has to serve if the judgment should become final. As a rule, the handcuffs do not click immediately, but a load follows to start in prison.
The BGH only checks the Dresden judgment for legal errors. So he does not hear witnesses and does not raise any evidence. The highest criminal judges can then confirm, change or cancel the judgment of the lower court. In the last case, the controversial parts would have to be negotiated in Dresden. It is unclear whether the Karlsruhe Senate is already making a decision. (Az. 3 StR 173/24)
E. is considered a head of the group
In addition to E., three men were also charged in Dresden. The allegations of the Federal Prosecutor’s Office were difficult. According to the prosecution, the group brutally beaten the group between 2018 and 2020 actual or supposed supporters of the right -wing scene in Leipzig, Wurzen and Eisenach. According to the indictment, 13 people were injured, two of them potentially life -threatening.
E. is considered a head of the group at the federal prosecutor. In at least two cases, it is said to have led the command. The Karlsruhe authority had requested eight years in prison for E.. Her defense had pleaded for acquittal and argued that the process was politically motivated and led in the wrong place.
Process is accompanied by protests
Sympathers protested against the OLG judgment on the day of the announcement in several cities. There were partially riots and clashes. According to the police, a meeting was declared in Leipzig after bottles and pyrotechnics were thrown towards the officials. Solidarity ranges for Lina E. were also available in Berlin, Hamburg and Dresden.
Protests are also expected today. Among other things, the Karlsruhe local group of “Red Aid” called for a rally before the BGH, “to accompany the process through solidarity presence”. The court had tightened the registration and access regulations for press representatives and spectators for the negotiation.
More alleged accomplices in custody
The group around Lina E. recently made headlines more often. In November, the federal prosecutor was able to arrest a long -broken suspected accomplice – Johann G. The former partner of E. is said to have taken a “highlighted position” within the group. Among other things, in February 2023 he is said to have attacked in the Hungarian capital Budapest together with other people who, from the point of view of the attackers, were assigned to the right spectrum.
In connection with the attack on actual and supposed neo -Nazis in Budapest, seven -diving people had also faced the authorities in January. Your defenders want to prevent delivery to Hungary and call for criminal proceedings in Germany. Because: In Hungary, their clients threaten a conviction for a “overlap sentence” of up to 24 years, the proceedings there are not sufficient legal principles that the conditions of detention are inhumane.
The case of another accused in the complex also caused a sensation last summer. The person born in Jena, who identifies itself as a non -binary and is known as “Maja”, was arrested in Berlin in December 2023 and delivered to Hungary in June 2024 – although the Federal Constitutional Court prohibited the urgent procedure. But the decision from Karlsruhe came a few minutes late. To this day, the hurry provides criticism. Today, the Federal Constitutional Court wants to announce its decision in the main proceedings.
