US judge stops the plan to exclude transgender soldiers from Army

Again there is legal headwind for US President Donald Trump. After a judge arranged a few days ago, Trump should re-terminate dismissed employees in government agencies, a judge is now blocking the plan to exclude transgender soldiers from the army.
In a “emphasis -made statement”, the district judge Ana C. Reyes Trump complained and issued an injunction that allows transparent soldiers to continue to serve in the army. At least for so long, until the Trump push was decided in court.
In her reason, Reyes referred to the constitution: “The ban basically uses derogatory language to target a vulnerable group in contradiction to the fifth constitutional additive.” Among other things, this states that no one can be restricted in his life, freedom or property without a fair procedure.
The judge stated on 79 pages, which is why the Trump government’s plan was not legal. One of her argumentation points is that there is no evidence that transpersonen would not be suitable for the army. In February, when it presented the plan, the government had argued that a man who identifies himself as a woman “was not compatible with the humility and selflessness that is required by a soldier”.

Reyes decision was preceded by a hearing on March 12, in which she asked the lawyers of the Ministry of Justice to decide to exclude transpersonen from the army. Even then, the judge showed her frustration about the lawyers’ line of argument. This is so thin that the Ministry of Justice could simply quote from the current Beyoncé album, said Reyes.
According to the US Department of Defense, there are currently around 4,200 transpersonen in the army, which corresponds to a share of 0.2 percent, reports the “New York Times”. She also spoke to members of the military.
According to the government’s advance, transpers were discriminated against in the armed forces and were forced to use the pronoun of their biological gender for themselves, they were supposedly failed to provide medical care or were sent to their home by missions.
