Does the Dresden Higher Regional Court have to deal with Lina E. again – or does the left -wing extremist have to go to prison two years after her conviction? The BGH checked the case.

The Federal Court of Justice (BGH) has examined the conviction of the left -wing extremist Lina E. – and now wants to announce its decision in Karlsruhe. When it comes to the Higher Regional Court (OLG) Dresden, E. should prison in Saxony and Thuringia for several attacks on actual and supposed supporters of the right scene between 2018 and 2020. The accused itself is not expected for today’s judgment.

In May 2023, the OLG Dresden Lina E. spoke guilty of dangerous bodily harm and membership in a criminal association. There was a prison sentence of five years and three months. The judgment triggered violent protests nationwide in the radical left -wing scene. Both the Federal Prosecutor and the defense of the 30-year revision today.

Does the OLG have to negotiate?

In February, the BGH in Karlsruhe therefore negotiated the matter. Both sides applied to cancel different parts of the more than 400 -page judgment and to refer to the new decision.

One argument is that after the Dresden judgment, the BGH has changed its jurisprudence for the evaluation of further acts in the event of membership in a criminal association. The question was also whether E. acted as a ringleader. The OLG had attested her a prominent position in the group, but denied a ring of ringing.

In front of the courthouse, a few dozen sympathizers from E. gathered for a rally on the day of the trial, and numerous police officers were deployed. The court had tightened the registration and access regulations for press representatives and spectators for the negotiation. These stricter rules also apply to the announcement.

The highest criminal judges in Germany examine the judgment of the OLG exclusively for legal errors. So no witnesses were heard or new evidence was raised. The Senate could now confirm the judgment of the lower court, change it itself, or – in whole or in part – to remove it and refer back to Dresden.

Lina E. is currently at large. The arrest warrant against you was understood with the Dresden judgment in 2023 under conditions – after two and a half years in custody, it was initially released despite the imprisonment imposed. The remaining penalty only has to serve if the judgment should become final.
