Courts only raise relatively few asylum notices
Last year, more than one in third parties took advantage of the new free asylum procedural advice. If an application is rejected, those affected often move to court.
The state -funded free asylum procedural advice has taken around 108,000 asylum seekers in the first two years. According to the Federal Government, around 33,000 asylum seekers nationwide made use of advice independent of the authorities nationwide. Government decided funding at the end of 2022
The traffic light coalition had decided on the state funding of independent asylum procedural advice at the end of 2022 in the law on accelerating the asylum court proceedings and asylum procedures, which was criticized by the Union at the time. At the same time, the SPD, Greens and FDP completed the so -called rule check by the BAMF. So far, this examination has been automatically looked after a certain period of time whether there are reasons for a revocation or withdrawal of the recognition of the asylum authorization and the award of the refugee status. According to the Federal Government, 2,747 employees are currently dealing with the processing of asylum applications. 396 BAMF employees take care of so-called Dublin procedures, which affect asylum seekers, of which another European country is responsible for the application. 117 employees are employed for withdrawal and withdrawal procedures. A revocation of protection status is pending if the situation in the country of origin has changed fundamentally. There is withdrawal procedures if there are indications that someone was wrongly granted protection, for example in the event of incorrect information on identity. As can be seen from the Federal Government’s response to the German Press Agency, about every second adult (49.9 percent), who for the first time in Germany submitted an asylum application in Germany, presented no pass, ID card or passenger sentence.
95.8 percent of the reviews end with protective confirmation
According to the information, 52,613 decisions were made in withdrawal or withdrawal procedures last year. The protection status granted was only revoked in 1,863 cases. 366 cases ended with the withdrawal of protection.
Less successful asylum lawsuits
German administrative courts upheld fewer lawsuits against asylum notices in 2024 than in previous years. As the Federal Government of the Left Group announced, only 18 percent of those seeking protection successfully complained about a decision by the BAMF last year. In the previous year, the courts had received 24.4 percent of BAMF decisions. In 2022, the judicial cancellation rate was in the procedures that did not take place for formal reasons – for example due to a withdrawal of the lawsuit – 36.5 percent. Not only people whose asylum application was rejected move to court. Asylum seekers who have received subsidiary protection, as far as many Syrians are concerned, sometimes complain – for example so that they can catch up with their family members. Because for this group there were recently restrictions on family reunification. The Union and SPD are now considering that the family reunification for those who are entitled to subsidiar soon.
The increased proportion of rejected complaints indicates improved decision -making practice of the BAMF. This may be related to the fact that the authority had to process fewer new asylum applications last year than 2023, which could have favored a more thorough processing. In 2024, a total of 229,751 people submitted an asylum application for the first time in Germany. There were also 21,194 asylum applications. The number of applications decreased by 30.2 percent compared to the previous year.
Large differences in protection rates
However, if you look at the individual BAMF locations, there are certain abnormalities. The comprehensive protection rate for applicants from Afghanistan was over 90 percent in the majority of local BAMF offices. It was only 60.8 percent in the Eisenhüttenstadt branch. The declaration of the federal government, which refers to a lower proportion of female protection seekers from Afghanistan at this location, is not convincing from the left point of view.
While 98.6 percent of people from Somalia, whose asylum applications were decided in Munich, received a form of protection, the comprehensive protection rate for applicants from Somalia in the Brandenburg Eisenhüttenstadt was 50 percent.
Left-wing politician cannot find differences understandable
“I would like to know what’s going on in Eisenhüttenstadt,” says left-wing MP Clara Bünger. “In the asylum procedure, the same opportunities must apply to everyone.”
