Chance to stay for 82,000 foreigners recovery comes

For more than two years, foreigners in Germany have been given the chance to acquire permanent right to stay. The corresponding law expires at the end of this year.
A special rule in the right of residence has received a prospect of staying in Germany since their introduction two years ago. Until February 28, a corresponding residence permit in the central central register was recorded for 82,474 people, as the Federal Government announced in response to a question from AfD MP Sebastian Münzenmaier.

The law on the right to stay in chance came into force on December 31, 2022 and applies for three years. It affects people who were tolerated, allowed for at least five years as of October 31, 2022 or were in Germany with a residence permit. Together with your relatives you can get a kind of residence permit for 18 months.
The tolerated are people who are subject to departure but cannot be deported for certain reasons – for example because they have no ID documents or are sick. The tolerance is always limited. The chances of staying the chances for criminals and for people who “repeatedly provides incorrect information” and thereby prevented their deportation is out of the question.

AfD requires immediate end to the right to stay.
At the end of 2025 the possibility of submitting an application according to the Opportunities Stay Act. The AfD MP Münzenmaier still sees a need for action. He says: “If the Union is serious about the turnaround of migration, it must immediately end the traffic right of residence of the traffic lights.” He is – like many Union politicians – against the grain that people have been given a prospect of staying here, which had hindered their deportation by false or incomplete information on identity and origin.
In the coalition agreement agreed between the negotiators of the CDU, CSU and SPD, it is said that for a federated foreigner with a clarified identity that is well integrated, have sufficient knowledge of German and have mostly secured their livelihood for a year, and which have been in Germany for at least four years for at least four years, a temporary residence permit should be created.
Higher requirements planned
“This regulation is likely to build on the right to stay, but places higher requirements from the outset and resembles other existing retention rights regulations,” says an analysis of Pro Asyl. However, the language requirements are higher in the intended regulation than in the so -called employment entitlement and the right to stay with well -integrated young people and young adults.
Countertlocther Alexander Throm (CDU) emphasizes that the right to stay agreed in the coalition agreement for people who mostly secure their livelihood themselves has nothing to do with the old regulation. Throm, who has participated in the negotiations, says: “The right to stay reserves expires this year, we will not extend that.” There will only be a temporary right of residence for “best integrated people who have been here for years and have been working, have disclosed their identity and adhere to the laws”. Above all, it was important to the Union not to “provide identity decays with a right to stay, as was the case with the right to stay in chances”.
