Point victory for Trump in court: Customs continued to be valid for the time being

The struggle for President Trump’s tariffs goes into the next round. The US government has successfully resisted a judicial blockade of its punitive levies-for the time being.
The controversial tariffs of US President Donald Trump against numerous countries remain in force for the time being: an appellate court in the United States granted an objection from the US government in an urgent procedure on Thursday against the abolition of these tariffs by a previous court judgment. The appellate court will only decide later.
A US trade court had previously lifted most of the Trump customs surcharges on Wednesday. Trump exceeded his powers with the appeal to an emergency law of 1977, the judgment said. Trump could not rely on the emergency law to “impose an unlimited surcharge on goods from practically every country,” said the three judges at the court for international trade (ITC). The congress is responsible for foreign trade.

Trump has been a hard trading policy course since the beginning of his second term, which has shaken the global supply chains and the stock markets. The President called April 2 to the “Liberation Day” and imposed high additional duties against most of the USA. A short time later, he reduced the surcharges for 90 days to a minimum rate of ten percent to enable negotiations. The current judgment also refers to tariffs, which Trump has depends on Canada, Mexico and China because of their alleged responsibility for drug imports, especially fentanyl.
The US tariffs of 25 percent are not touched by the judgment on cars and steel and aluminum products that continue to apply. Trump had recently threatened the EU with tariffs of 50 percent from July 9, but they are not yet in force to negotiate with the EU.
White house is annoyed by judgment against tariffs
The White House had previously harshed the judgment of the commercial court. The verdict was “obviously wrong”, the White House said on Thursday in online media shortly before the decision of the Court of Appeal. It threatened to go to the highest court. Previously, Trump consultant Stephen Miller had already spoken of a “Justice Putsch” because of the organized suspension of the tariffs.
According to the judgment of the Court of Appeal, Trump’s trade representative Peter Navarro told journalists that the US government had received “a lot of calls from countries” who continued to negotiate “in good will”. He did not name the name.
The Commercial Court had given the White House ten days in order to complete the procedure for lifting the tariffs imposed. This period is now obsolete by the judgment of the Court of Appeal. Five smaller US companies had sued the tariffs, which, for example, import wine, bicycles and electronics kits and were economically threatened by the tariffs. Twelve US states were also brought to court, they accused Trump’s breach of the constitution.
