Interior Minister Dobrindt has ordered that asylum seekers can be rejected at the limits. The regulation is controversial. A man had sued. Now there is a judgment.

The rejection of asylum seekers at border controls in the German area is illegal after an endurance decision by the Berlin Administrative Court. Without the implementation of the so-called Dublin procedure, they must not be rejected, the court decided. In the specific case, it was about three Somalier, who were sent back to Poland from Frankfurt (Oder) according to the new regulation on May 9.

Two men and a woman from Somalia had complained about rejection at the border

According to a court spokeswoman, it is the first judicial decision on the new regulation of Interior Minister Alexander Dobrindt. The CSU politician had intensified border controls a few hours after taking office in early May. At the same time, he ordered that asylum seekers can also be rejected at the border.

In the present case, there were two men and a woman from Somalia who traveled from Poland to Germany by train. On May 9th they were checked by the federal police at Frankfurt (Oder). After expressing an asylum application, they were rejected to Poland the same day. According to the court, the federal police justified the rejection by entering a safe third country.

On the other hand, those affected defended themselves to the administrative court by urgent procedure. According to court, the decisions are inconceivable.
