According to a court decision, three Somalians should not have been rejected at the border. Interior Minister Dobrindt does not want to be impressed by the decision.
Federal Interior Minister Alexander Dobrindt (CSU) adheres to the rejection of asylum seekers, although a court decision nourishes doubts about their legality. “We also stick to our legal opinion,” he said in Berlin.
Dobrindt emphasized several times that it was a decision in individual cases. “There is no reason due to a court decision that has been made here today in this individual case to change our practice.”
Administrative court: rejections are illegal
The Berlin Administrative Court had noticed in an endurance decision that the rejection of asylum seekers during border controls in the German field was illegal. Without the implementation of the so-called Dublin procedure, they must not be rejected, the court decided.
The Dublin Ordinance determines which EU state is responsible for an asylum procedure. In the specific case, it was about three Somalier, who were sent back to Poland from Frankfurt (Oder) according to the new regulation on May 9.
The Federal Minister of the Interior said that he now wanted to strive for the main proceedings. You believe that you will “get clearly” there. “In this decision, the court stated that the reason for our measures should have been more dedicated.” One now wants to deliver this more decidental justification.
Dobrindt: Migration policy system is dysfunctional
Dobrindt had an intensification of border controls on May 7, a few hours after taking office as Federal Minister of the Interior. At the same time, he ordered that asylum seekers should also be rejected at the border in the future. However, this should not apply to pregnant women, children and other relatives of vulnerable groups.
According to Dobrindt’s information, 2,850 people were rejected at the German borders between May 8 and June 1st. An asylum application was provided in 179 cases. In 138 of these cases there was a rejection, 41 cases, on the other hand, have been one of the vulnerable groups.
According to his information, the Somalians, who had called the court in Berlin, had already tried to enter Germany on 2nd and May 3, without putting on an asylum application. You would only have done this on the third attempt on May 9th.
“You can see how difficult the situation is now, how complex it is and how, I would say, the situation of the entire asylum system has now become dysfunctionally,” said Dobrindt.
