Court of Appeal returns Trump’s control over national guard

Donald Trump had sent the national guard to Los Angeles in the course of the protests. The mission has now been blocked by a federal judge. Shortly afterwards there is a U -turn.
In the United States, a court of appeal has tipped a judicial order for control over the national guard for the time being. On Thursday (local time), the court suspended a decision by the US district judge Charles Breyer based in San Francisco. This had again put the national guard used by US President Donald Trump in Los Angeles under the control of the California governor Gavin Newsom and thus prevented her commitment to demonstrators in Los Angeles. However, the US government made an appeal against the order. The decision of the Court of Appeal does not mean that there will be Trump right. However, he keeps command of the national guard.
Previously, a court had classified the commitment of the national guard against the will of California governor Gavin Newsom as illegal. “His actions were illegal,” says judge Charles Breyer in relation to Trump. On Thursday evening, the judge instructed the president to “immediately” return control of the California National Guard to the state. The judgment was available to the AFP news agency.
However, Breyer exposed the arrangement until Friday, 12 p.m. local time (9 p.m. CEST). The White House immediately appealed against the judgment – the case could go to the highest court.
California’s governor welcomes judgment against Trump
“Donald Trump will be relieved of his office tomorrow,” said Governor Newsom in a first statement after the judgment was announced. “He is not a monarch, he is not a king, and he should stop behaving like one.”
Trump had appointed 10 on Title 10, a rarely applied law, to order a total of 4,000 national guards to Los Angeles. Usually the governor of a state mobilizes the national guards to support natural disasters.
The Republican had justified the step by the fact that the protests in Los Angeles had come out of control against the approach to immigrants ordered by his government and the city “burned”.
Newsom had sued against the use of the national guard
However, Gavin Newsom, the democratic governor of California, saw no need to use the troop to calm the protests. Trump still sent the national guard going. Most recently, President Lyndon B. Johnson activated the national guard against the will of a governor in 1965 to protect civil rights activists in Alabama.
Title 10 allows the National Guard to be used in the event of “a rebellion or the risk of a rebellion against the authority of the United States”, but does not authorize the troops to take over the tasks of the police.
