The US President and the California government argue in court for the use of the National Guard in Los Angeles. A decision in favor of California has now been overridden.
US President Donald Trump may continue to use the national guard in the state of California. On the late Thursday evening (local time), an appellate court blocked a order of the district court in San Francisco, which was only a few hours old, against which the US government had objected.
Judge Charles Breyer from the District Court in San Francisco declared the sending of the National Guard in California to be illegal on Thursday. Trump had exceeded his authority and had to return control of the national guard to the California government, it had said in the reason.
The injunction should actually come into force on Friday afternoon, but has now been overridden until another hearing on Tuesday. Trump can continue to use the national guard on the weekend on which several rallies are planned in Los Angeles.
Demonstrations against Trump’s migration policy
The dispute between the US government and the west coast state was preceded by demonstrations against Trump’s tough migration course and offspring of the ICE immigration authority. The US government therefore mobilized 4,000 soldiers from the National Guard and 700 naval fanciers of the regular armed forces for the deployment in Los Angeles. The soldiers gradually arrived and, according to Trump’s will, should stay in the city until there is no danger. So far, an assignment has been scheduled for a maximum of 60 days.
California’s democratic governor Gavin Newsom had sharply criticized the sending of thousands of soldiers from the National Guard and the planned use of marine fountains at the behest of Trump in Los Angeles. After the decision of the district court in San Francisco on Thursday, he spoke of a “big day” for democracy and for the constitution of the United States. Trump has to stop taking up like a ruler or king, newsoma said at a press conference. At first, he did not comment on the decision of the Court of Appeal.
Unusual demonstration of power
In the United States, states normally have control over the national guard. If there is a war or national emergencies, the US President can take command. Nationwide protests announced on weekends

Padilla had interrupted Noem when she commented on the continuing protests against Trump’s migration policy on site. Security forces immediately intervened and dragged it out of the room. Senators enjoy high reputation as high representatives in the United States. The outrage after the incident was correspondingly great.
Governor Newsom said on X that Padilla was one of the most decent people he knows. “This is outrageous, dictatorial and shameful”. The Ministry of Homeland Protection said that the Secret Service initially suspected a potential attacker in the situation.
