The Supreme Court in the USA further limits the rights of transpersonen. Activists had sued a law in Tennessee – and lost.
In a much-noticed model case, the Supreme Court of the United States has declared the ban on gender-relevant interventions in minors at the state of the state. The Supreme Court in Washington approved a law in Tennessee on Wednesday that prohibits puberty blockers or operations for gender adequate for people under the age of 18. In contrast, activists for trans-rights had sued and were supported by the former President Joe Biden.
The six conservative judges of the Supreme Court ruled against the votes of the three liberal judges that the law in the southern state of Tennessee did not violate the equal treatment requirement of the US constitution. The plaintiffs, on the other hand, saw people discriminated against people who did not identify with their gender set at birth. They cited the 14th additional article of the US constitution, which provides for equivalent protection for all citizens.
The judgment is considered victory for the opponents of trans-rights in the United States, especially US President Donald Trump. At the beginning of his second term in January, he announced that there were only two genders in the United States; Male and female. Trump also signed a decree that prohibits gender -accumulating measures for children and adolescents. A total of 24 republican ruled states had issued similar bans in the past.
Trans-young people had sued in Tennessee
At an oral hearing in December, Tennesses Attorney General Matthew Rice argued that the law protects “minors from risky, not proven medical interventions” with often irreversible consequences. This was denied by the American Civil Liberties Union (ACLU) civil rights movement, which represented three transgender youth, whose parents and a doctor. The law in Tennessee had taken away the young people “the only treatment that could have ended the years of suffering”, argued ACLU lawyer Chase Strangio.
According to a study by the University of California, around 1.6 million people in the United States are defined as a transgender. More than 300,000 of them are between 13 and 17 years old. More than a third of these young people live in one of the states with a ban on sexual operations.
