The US President and the California government argue about the use of the National Guard in Los Angeles. An appellate court now decided in favor of Trump. But the dispute is not over.
US President Donald Trump has achieved a further stage victory in the dispute over the commitment of the National Guard in the state of California. The US government may keep control of the approximately 4,000 soldiers of the National Guard who had sent Trump to the western coast metropolis of Los Angeles because of demonstrations, an appellate court in San Francisco decided on Thursday evening (local time).
The court thus overridden an injunction from the district court in San Francisco, which had declared the sending of the National Guard last week by the US government. The Court of Appeal had previously blocked the order until a final decision after the US government had objected.
Now a three -member body – including two by Trump and one of the judges appointed by ex -President Joe Biden – decided unanimously in favor of Trump.
Trump celebrated the decision on his Truth Social platform as a “big win”. “This is a great decision for our country, and we will continue to protect and defend the lawsuit of the law.”
California’s governor Gavin Newsom was disappointed in a message and announced that “President Trump’s authoritarian deployment of US soldiers against citizens”. The West Coast State can now ask the Court of Appeal to renegotiate the matter or draw directly in front of the Supreme Court, wrote the “New York Times”.
Demonstrations against Trump’s migration policy
The dispute between the US government and the west coast state was preceded by demonstrations against Trump’s tough migration course and offspring of the ICE immigration authority. The US government therefore mobilized 4,000 soldiers from the National Guard and 700 naval fanciers of the regular armed forces for the deployment in Los Angeles. According to Trump’s will, they should stay in the city until there is no danger. The use was initially scheduled for a maximum of 60 days.
California’s democratic governor Gavin Newsom had sharply criticized the posting. In the United States, states normally have control over the national guard. If there is a war or national emergencies, the US President can take command. The National Guard is a military reserve unit and part of the US armed forces. For example, it can be used for natural disasters, unrest or emergencies inside.
