The highest EU court weakens sports court
In the event of disputes in the sports world, the International Sports Court in Lausanne actually has the last word. But now there is an important judgment.
Arbitration from the International Sports Court CAS may be checked by state courts in the EU, according to a judgment of the European Court of Justice. The highest European court stated that it must be possible to check whether the arbitration sayings are compatible with the public order of the European Union.
The judge’s decision in Luxembourg means a significant weakening for the CAS: So far, the judgments of the sports court were final. Only the Swiss Federal Supreme Court was able to tip the decisions of the arbitral tribunal resident in Lausanne in the event of errors in procedures.
Belgian association argues with FIFA
The international sport wants to ensure with the sports court that there is a uniform interpretation of the regulations in sports worldwide. The CAS decides, for example, about disciplinary penalties, transfer permits and doping locks. The walk before the CAS has so far been the last sport of sports lawyers for athletes and associations.
In the specific case, the Belgian Football Association RFC Seraing has been fighting for more than ten years with the FIFA World Association for the ban on the so -called third -party ownership. This regulates that the economic rights of players must not be sold to investors. The ban is defined in the regulations of FIFA, the European Football Union UEFA and the national associations.
