“Thus, it is not noticed that the contracting indicated in the complaint contains an illegal maneuver, since, having seen the results of the investigations carried out, it is not verified how this link could result in an unfaithful conduct of the assets whose administration has been entrusted to Tapia, without prejudice to the personal knowledge that could link the representatives of both parties”maintained the failure, of about 30 pages.

The case began as a result of a series of complaints sent by e-mail by an organization called Argentine Association for Financial Transparency in Football (AATFF)on alleged irregularities in the exploitation of the friendly matches of the national team and other sports-commercial activities of the AFA.

“The numerous inaccuracies and even fallacies contained in the complaints that gave rise to these actions cannot be ignored, as verified by the Prosecutor (Eduardo Taiano) during the investigation carried out”Judge Lijo held in his resolution.

“It is not envisaged that the deepening of the investigation could reasonably throw up new elements at this point that allow the incriminating evidence gathered so far to be distorted and, instead, lead to corroborating any of the circumstances that were ventured in the complaint”he added.

With Wall and Tofoni were also dismissed Daniel Ferreiro -collaborator of the president of the AFA-, Jonathan Tanzi (former head of Central Barracks), Charles Varela (company owner Metro World Digital) and Marcelo Diment (of the company cell bank).

The complaint of the AATFF mentioned an alleged request for illegal payment of one hundred thousand dollars to favor the conclusion of an image contract in the matches of the selected team and the favoring of the company of Tofoni from friendship with Wall which was over 20 years old.

“The investigations carried out to date have not provided elements that give credence to the reported circumstances or that allow us to presume that the contracting in question pursued any fraudulent purpose”upholds the ruling.

However, it clarifies that “Naturally, the assessment of the convenience or the success that the holding of that business constituted for the association in commercial terms is outside the scope of a criminal investigation”Lijo said.

The judge followed the discretion of the prosecutor Taianwho highlighted that Wall signed the contract with Tofoniwho “It is linked to the sports entertainment service for more than 25 years, which is the exclusive organizing agent of AFA international matches, having managed more than 50 friendly matches for the Argentine national team in different cities around the world.”
