The request was presented by the deputy general prosecutors of San Isidro, Patricio Ferrari and Cosme Iribarren, and the prosecutor of Benavídez, Laura Capra, before the judge of Guarantees 2 of that judicial department, Orlando Díaz, a few days after one year and five months after the death of “Ten”, as a result of pulmonary edema and heart failure during a home stay in the private neighborhood of San Andrés, in the aforementioned district.
“When, strictly speaking, the controls had to be intensified in an outcome that was not at all fortuitous, inversely, and while the victim almost shouted his sad end due to the helpless situation in which he had been placed, abandoning him to his fate, they decided, all of them, contribute all their lack of foresight with the crudest actions that have been seen at the service of those who are now no longer there”prosecutors noted in their 378-page request to which Télam agreed.
“That and the reality of what happened was not another. The truth is never sad, what has no remedy,” they remarked.
This requirement includes the eight defendants already investigated in the case: the neurosurgeon and at the time the “10” family doctor, Leopoldo Luciano Luque (40); the psychiatrist Augustine Cosachov (36); the psychologist Carlos Angel “Charly” Diaz (30); the coordinating doctor of the prepaid Swiss Medical, Nancy Edith Forlini (53); the nurse coordinator Mariano Ariel Perronithe nurses Ricardo Omar Almiron (38) and Dahiana Gisela Madrid (37); and the clinician Pedro Pablo Di Spagna (49).
All of them, the prosecutorial team specially created for this case by the attorney general of San Isidro, John Broyad, accuses them as co-authors of a “simple homicide with eventual intent”, after concluding that Maradona’s medical team was “deficient”, “reckless” and “indifferent”, that he knew that “Ten” could die in the state he was in and that he did nothing to prevent it.
Despite the fact that it is a crime that has an expected sentence of 8 to 25 years in prison, the prosecutors never requested the arrests and the eight accused will reach the debate in freedom.
For the judicial investigators, the defenses that the defendants made in the file “clearly show the desperate attempt of each one of those responsible for this mess to improve their compromised procedural situation, rising up against each other and with the clear purpose of defining their responsibilities falsely placing that extreme at the head of others”.
“The omission of specific acts that had to be carried out and those contrary to the art of health placed the victim in a situation of helplessness rarely seen, freeing him to his fate”prosecutors said.
They also emphasized that the defendants “were the protagonists of an unprecedented, completely deficient and reckless home internment”; and that they committed a “set of improvisations; mismanagement and shortcomings.”
“The home admission itself, while it lasted, was outrageous”they considered.
One of the keys to the accusation was the conclusions reached by the medical board of experts who analyzed the circumstances of Maradona’s death for two months.
There, 17 of the 22 experts who participated concluded that Maradona was a patient with multiple pathologies who died 12 hours before dying, that “he was not in full use of his mental faculties” and that he could have had “more chances of survival” if he had been in a clinic.
The board stated that “the treating medical team fully and fully represented the possibility of a fatal outcome for the patient, being absolutely indifferent to this issue, not modifying their behaviors and their medical/care plan, maintaining the previously mentioned harmful omissions, abandoning ‘ to chance’ the patient’s state of health”.
For his part, Judge Díaz will now review the prosecutor’s request to the parties, it is expected that the defenses will present oppositions and requests for dismissal, and then he will decide whether to bring the file to trial so that the oral court of San Isidro that you will have to do the oral debate.
