To avoid acephaly, the IGJ registered the new AFA authorities

In this regard, the organization led by Ricardo Nissen points out that “The resolutions adopted in the Extraordinary General Assembly of May 19, 2020 were approved by this General Inspectorate of Justice in file N 9157118, in which it was decided to authorize and register the reforms made to the AFA bylaws.”

However, the IGJ clarifies that San Martín de Tucumán “filed a lawsuit before the National Court of First Instance in Civil Matters No. 89 of this City, in cars titled ‘Club Atlético San Martín against Argentine Soccer Association on nullity of legal act’ which is in full process ”.

“These last circumstances generated a shift in the mandates of the AFA’s administrative body, which, by express statutory provisions, begins its action after the Ordinary General Assembly that is held during the month of October. From this it is evident that if the election had been held during the month of October 2021, the institution would have had its authorities with an expired mandate for several months, with all the innumerable damages that this circumstance could cause to the AFA ”.

In this sense, Nissen acknowledges that the May 19 assembly “could be classified as premature” since it was to be convened in October, but warns that “This opinionable action is not enough, in my opinion, to deny the registration of the appointment of elected authorities in said assembly and reject the authorization for them to assume their positions.”

Along these lines, the IGJ warns that if the AFA could not count on its duly registered and authorized authorities, this could lead to a situation of acephaly, which constitutes “A situation likely to cause very serious damage, as is easy to imagine.”
