Alves’ lawyer had asked for his release on bail if he surrendered his passport and wore an electronic bracelet, arguing that he had family ties in Spain. However, the court rejected the arguments and ordered him to remain in pretrial detention in the Brians 2 prison, on the outskirts of Barcelona.
“Examined all the arguments, we share with the accusations that there is a high risk of flight linked, on the one hand, to the high sentence that can be imposed in the present case, the severe indications of criminality against him and the bulky economic capacity that they would allow him, as we have said, to leave Spain at any time,” said the Court.
The case received a great deal of attention in Spain, due to Alves’ profile, but above all because sexual assaults remained a dominant political issue since the gang rape of a teenager in 2016 during the San Fermin running of the bulls, which led to the hardening of laws against sexual violence in the country.
In Spain, a rape complaint is investigated under the general charge of sexual assault and convictions can carry prison terms of between 4 and 15 years.
The conviction for these types of charges also paves the way for the payment of economic compensation to the victim to cover physical, physiological and moral damages.
