The judge, who was in charge of the case while the challenge presented against her colleague who suspended the elections, Débora Abrevaya, was analyzed, invoked in her excuse that she herself is a member of the “xeneize” club.
“Considering that important elements have been gathered that justify the adopted temperament, I resolve to excuse myself from considering these proceedings,” the judge said in the three-page resolution.
The judge stressed that she retains her impartiality to intervene in the case, but recalled that the code of procedures establishes that being a member of the club that is under judicial analysis is an objective reason to apply a criterion of prudence and excuse herself to allay any fear of bias. .
“Since I am a member of the Boca Juniors Atlético Club, and taking into account what has been said by jurisprudence (…), I consider it prudent to excuse myself from participating in this process in order to preserve the due administration of justice and neutralize “any fear of bias that such a circumstance could harbor in those subjected to trial,” he said.
“For the rest, it should be noted that the impartiality of the judge in the case implies the objectivity of the jurisdictional activity to enable a trial that meets the constitutional requirements. In this sense, it is worth stating that in the face of this, or any other process that is subject to trial, I will have to preserve impartiality without personal involvement that could influence my decision,” he stressed.
Romero, who was left with the case by draw after Abrevaya’s challenge, had been questioned on Monday by the club’s current vice president and presidential candidate, Juan Román Riquelme.
