The Argentine Sports Confederation (CAD) headed by its president, Rodolfo Paverinifiled a collective appeal against the Decree of Necessity and Urgency (DNU) N°70/2023signed by the Head of State, Javier Mileiwith which it seeks to declare the unconstitutionality and absolute nullity of the aforementioned decree, arguing that it violates the Constitution of the Argentine Nation.

The CAD requested an urgent precautionary measure to stop the effects of the DNUwhich among other things, modifies the Sports Law to allow the entry of Sports Joint Stock Companies (SAD) and in its argument, the confederation highlighted that the government has used an extraordinary resource inappropriately, introducing the SAD of a sporting object without justification in the sporting field.

The sports entity argued that the legislative reform not only affects the structure of national sports but also has direct implications on the participation of soccer teams in international tournaments, including the Paris Olympic Games and the America Cup in USA that will take place this year.
He also maintained that the urgency proclaimed by the Executive power has no basis in the sporting field and criticized the degradation of national sport when the ministerial rank lost its application authority, being relegated to a Secretary.
Regarding football, the confederation highlighted that the majority of clubs modified their statutes to prohibit the transformation into Sports Joint Stock Companiesand the Argentine Football Association (AFA) followed a similar line.
The actions of the government, according to the CADviolates the autonomy recognized by law to civil sports associations and could result in sanctions by international organizations such as the FIFA and CONMEBOL.
This appeal for protection marked the first significant movement of sports institutions towards the judicial sphere and generated uncertainty about the future of Argentine sports and its participation in international events.
