In a note sent to the Court, the San Martín club asked him to “proceed to apply the current regulations, article 80 of the AFA Regulations on Transgressions and Penalties, and order the loss of the match to Club Atlético Tigre, without prejudice to “other sanctions that it considers necessary”.

The match between Tigre and Chacarita, for the 32nd finals of the Argentine Cup, was suspended by referee Ariel Penel after the “funebrero” player Fernando Brandán received a bottle in the face thrown from a stand.

The attack occurred after Penel sent off Tigre midfielder Agustín Cardozo, and just moments after “Matador” took the lead with a goal from Brahian Alemán.

Shortly after the suspension, Aprevide reported that the Tigre fan who threw the bottle was arrested and identified him as Axel Iván Genes, member number 58,361 of the institution.

The match was played without the presence of Chacarita supporters, with access prohibited due to a sanction by security agencies after the episodes of violence in which a fan died on February 3, at their stadium in San Martín, in the match against Deportivo Maipú for the Primera Nacional.

The winner of this key will play in the round of 16 with the winner of the match between San Lorenzo and Independiente de Chivilcoy.
