Bail is set for Dani Alves so he can leave prison after 14 months

A Spanish court this Wednesday authorized the release of the Brazilian footballer from prison Daniel Alves in exchange for a bail of 1 million euros (almost 1.1 million dollars), while the appeals against his conviction for rape.

In its order, the Barcelona Court agrees to the release of the 40-year-old player “by paying a bail of 1,000,000 euros”, after which his Spanish and Brazilian passports will be withdrawn and he must stay away from the victim of the crime. rape, for which he was sentenced to four and a half years in prison in a sentence that is being appealed by both the defense and the Prosecutor’s Office and the private prosecution.

Alves, the court order says, is “prohibited from approaching the person of the complainant at a distance of no less than 1,000 meters from her home, place of work and any other place frequented by her, as well as from communicate with her by any means or procedure.”

The court’s decision is announced the day after the hearing in which his demand to be released while the appeals are resolved was examined, and in which Alves assured that he would not flee.

Alves’ lawyer, Inés Guardiola, argued, among others, that her client has already served a quarter of the sentence that the court imposed on him at the end of February – which, in the event of a final sentence, would enable him to begin receiving prison benefits. – and also assured that he would not escape, legal sources indicated.

The court, which used the risk of flight to reject Alves’ previous demands to be released, now considers in the order that “the passage of time” is a “mitigating factor” of previous criteria.

At Tuesday’s hearing, Alves, who appeared from prison via videoconference, assured the court that he would not flee if he was granted provisional release and that he believes in justice, the same sources pointed out.

These arguments did not convince, however, the Prosecutor’s Office, which continued to oppose the former FC Barcelona and Paris Saint-Germain player, among other teams, being released, as it considered the risk of escape high.

After a high-profile trial, section 21 of the Barcelona Court sentenced Dani Alves to four and a half years in prison for having raped a woman in the bathrooms of a nightclub in that Spanish city at the end of 2022.

The sentence also imposed an additional five years of supervised release, a restraining order against the victim for nine and a half years, and payment of compensation of 150,000 euros (about $163,000).

One of the most successful footballers in history, Alves played for clubs such as Sevilla and Juventus Turin, in addition to being part of Messi and Guardiola’s successful Barça team.

After his entry into provisional prison in January 2023, his team at that time, the Pumas of Mexico, terminated his contract.
