The Federal Court of Australia has postponed a new appeal by Serbian tennis player Novak Djokovic until January 16. The athlete until this moment will live in a hotel for migrants, CNN reports on January 15.
“A hearing has been scheduled for Sunday, January 16, 2022 at 9:30 a.m. ET,” Judge David O’Callaghan said in a statement.
Djokovic’s legal team, led by lawyers Nick Wood and Paul Holdenson, will present their case file to federal court by 12 noon on Saturday. That day, the court will also consider whether the hearing should be held on January 16 in the presence of one or three judges.
Djokovic will spend Saturday night in a hotel for migrants, as his visa to stay in the country was revoked, but the tennis player challenged the decision of the authorities. The first time the Australian authorities canceled Djokovic’s visa was on January 5 due to an error in the entry request. The athlete flew to participate in the Australian Open Grand Slam tournament. Australian Prime Minister Scott Morrison pointed out that the country has equal and undeniable rules for entry.
The 34-year-old Serbian tried to enter Australia without being vaccinated with a medical exemption from coronavirus vaccination, according to Sport-Express. The border service considered the data provided insufficient.
The tennis player himself said on January 12 that the human factor caused an error in his documents. According to him, the “no” checkbox was erroneously ticked in response to the question whether he had traveled to other countries in the 14 days before arriving in Australia.
However, providing false or misleading information in official form is an offense in Australia, which carries a maximum penalty of 12 months in prison and a fine of up to 6.6 thousand Australian dollars ($4730), and can also lead to cancellation of the violator’s visa.
The Australian Open 2022 starts on January 17 in Melbourne. Djokovic is a nine-time and current winner of the tournament.
