After the current president of the Supreme Court of Justice Horacio Rosatti was reelected for an additional three-year period, Ricardo Lorenzetti warned that “If the two new members join, we will go from three to five, and the authorities will have to be elected again.”

As anticipated by this media, the internal conflict within the Court had left Lorenzetti out of the agreement that led to the reelection of Rosatti, who played in tandem with Carlos Rosenkrantz. The latter gave his vote to the head of the court, as did Juan Carlos Maqueda, while Lorenzetti abstained.

The truth is that the deadline for electing authorities expired on September 30, date by which there would be no definitions on the lists of judges Ariel Lijo and Manuel García-Mansilla, those proposed by the Government of Javier Milei. That is why Rosatti will continue presiding over the Court until 2027. However, Lorenzetti said to Radio Mitre: “When the new ministers come in, we will elect, we will discuss.”

The judge also described the difficulties the court had in functioning with only three members. It is worth noting that Maqueda will leave his post at the end of the year, as he will turn 75 on December 29, maximum age allowed to continue exercising the office of magistracy unless approval is obtained from the Executive Branch and the Senate for a further five years, something that did not occur. “If the two new members join, we will go from 3 to 5 and we will have to elect the authorities again and look for new mechanisms,” said Lorenzetti, who also asked that the appointment of “a woman” be evaluated.

This will be Rosatti’s second term at the head of the Supreme Court with Rosenkrantz as vice president, as they were re-elected because the current term expires on October 1.

As president of the Court, Rosatti will also be in charge for another three years of the Council of the Judiciary of the Nation, in charge of selecting judges and carrying out removal processes in response to complaints.
